«Mirai Flights» Loyalty program rules

1. Terms and conditions

   Coupon — the functionality of the Service, which gives the User the opportunity to receive a Discount on the Service in the size and conditions specified by Mirai Flights and brought to the User on the Service with the help of such functionality. The granting of Coupons is possible in the manner and cases provided for by these Rules.

   Discount — the discount granted to the User on the cost of the Services when the User makes an order for the Services in accordance with the Terms of Use of the Service published under the link https://mirai.flights/conditions (hereinafter — Order) and use of the Coupon. The type of the Discount provided, the size and conditions of its provision are given in the description of the corresponding Coupon.

   Loyalty Program «Mirai Flights», Program — a loyalty program conducted by Mirai Flights, aimed at increasing the activity of the User in the use of the Service, in the purchase of Services. The terms of the Program shall be determined in accordance with these Rules.

   Service — mobile application Mirai Flights, websites miraipay.co or mirai.flights.

   Services — Air charter services («Flight services») in accordance with the Terms of Use of the Service, published under the link https://mirai.flights/conditions.

   Rules — this document, published under the link https://mirai.flights/loyalty_conditions.

   Mirai Flights is a Mirai Limited company registered under the legislation of the Republic of Malta, registration number C100074, whose registered office is located at: Avenue 77, Block E, Level 2, Commerce Street, Zone 3, Central Business District, Birkirkara, Malta.

2. As part of the Mirai Flights Program, the User may be provided with coupons for the User’s activity in the use of the Service, in the purchase of Services carried out by the User on the Service or using the Service. Mirai Flights independently determines the list of cases of granting Coupons to Users, as well as the type and conditions of use provided Coupons. The validity of any Coupon is determined by the Coupon Issue Terms.
3. To receive and use the Coupons User requires authorization on the Service under the account identifying the User.
4. Information about Coupons that can be used by the User, description Coupons are placed on the Service in the section «Coupons». When using the Coupon, the User is granted a Discount in the amount and terms given in the description of the corresponding Coupon. The Coupon Description may also be communicated by Mirai Flights to the User by other means (including email, other sections of the Service, other Mirai Flights sites and/or its partners).
5. The use of the Coupon, Discounts on the use of the Coupon may be limited at the discretion of Mirai Flights and/or subject to certain conditions. Such conditions may, in addition to those set out in this Regulation, include, but are not limited to:
   • a limited period of time during which the Coupon can be used, and after which it is considered invalid;
   • the maximum percentage of the Service price for which the Discount can be granted;
   • category or type of Services for which the Coupon may be used;
   • the possibility of using the Coupon and receiving the Discount only on the first Order or a limited number of consecutive Orders issued by the User on the Service;
   • other terms and conditions given in the description of the corresponding Coupon.
6. In order to receive the Discount, the User must use the Coupon with the help of the Service when making an Order, in accordance with the terms given in the description of the corresponding Coupon.
7. The Coupon is not a payment for the Cost of Services in full. The price of the Services including the Discount may not be less than 10 EUR, regardless of the size of the Discount specified in the description of the Coupon.
8. No more than 1 (one) Coupons may be used in respect of one Order unless otherwise provided by the description of the corresponding Coupons. In the event that the User has several Coupons that can be applied to the Service, the User selects the Coupon to be used if there is a technical possibility. If there is no technical possibility to choose a Coupon from several available, the Coupon, which grants the right to receive a higher discount (in percentage), is applicable. The discount on the Coupon may not be 100% of the Service Price.
9. One Coupon can be used by one User only once unless otherwise specified in the Coupon description. The coupon may not be transferred by the User to third parties unless otherwise provided by the functionality of the Service and/or in the description of the Coupon. 10. Coupons may not be used to receive Discounts for additional services not included in «Flight Servicing» in accordance with the Terms of Use of the Service published under the link https://mirai.flights/conditions.
11. The discount (both for used and unused Coupon) is not paid by money and is not converted to the internal account of the User. If the amount of the Discount is not used in full when ordering, the difference is not refundable and cannot be used by the User as part of new Orders (the remaining amount of the Discount burns up). In case of cancellation for any reason of the Order in full or in part, when the User was issued with the Coupon, and also in case of refund of the value of the Services paid by the User, the used Coupon shall not be refundable or re-provided to the User, unless otherwise decided by Mirai Flights. In the event of cancellation for any reason of the Order for which the User was provided with the Coupon, as well as in the case of refund of the value of the Services paid by the User, Mirai Flights is unilaterally entitled to cancel the Coupon provided at the execution of the specified Order (in this case the Coupon is excluded from the section «Coupons» on the Service).
12. The amount of the Discounts is indicated taking into account all applicable taxes.
13. In order to counteract misuse of Coupons Mirai Flights reserves the right to apply means of verifying the integrity of Coupons not specified in these Rules, as well as to refuse to grant the Discount in case of detection of appropriate abuse and/or unfair use of Coupons.
14. The use of the Coupon may not be available for technical reasons, including if the User does not renew the Application until the latest available version, and/or for other reasons.
15. The use of the Coupon implies the full consent of the User to these Rules.
16. When considering petitions concerning the use of the Coupon, the Mirai Flights Support Service has the right to request, and the User applying for the Coupon is obliged to provide proof of the fact of providing it with the Coupon: a screenshot of the Coupon page and/or other confirmation at the direction of the support officer. In the event of failure to provide such confirmation, Mirai Flights reserves the right to refuse the Coupon User’s use of the Coupon for receiving the Discount, as well as the Coupon Discount.
17. The User accepts these electronically hosted Rules unconditionally and irrevocably at the time of registration in the Service by entering a one-time verification code and creating a personal account in the Mirai Flights database, or through the websites miraipay.co or mirai.flights.
18. This Rules shall apply for a period of 30 days from the date on which them enters into force as specified in these Rules. The validity of these Rules shall be extended several times automatically for 30 days unless otherwise stated in these Rules by reference to https://mirai.flights/loyalty_conditions. The number of extensions during the validity period of the Program is not limited. The User shall have the right to accept these Rules during the period of validity of them.
19. Mirai Flights may at any time modify the terms and conditions of participation in the Program in these Rules. Mirai Flights is posted on the following link: https://mirai.flights/loyalty_conditions, without separate notification of this Account. The User undertakes to monitor amendments in the terms and conditions of participation in the Program by following the link: https://mirai.flights/loyalty_conditions.
20. Mirai Flights reserves the right to terminate and/or change the terms and conditions of use of the Coupon. Information about early termination and/or change of conditions of use of Coupons shall be communicated to the User by one of the following ways:
    • by specifying the Service;
    • by notifying the User by e-mail, by means of sms/push-message, by phone call or by other means at the option of Mirai Flights.
21. If Mirai Flights will find that the User has broken these Rules, published under the link: https://mirai.flights/loyalty_conditions, and/or misused of Coupons and/or improper use of Coupons, Mirai Flights reserves the right not to grant Coupons and/or refuse to provide Coupons and/or to cancel previously granted Coupons. In this case, Mirai Flights independently determines the ways and grounds for recognizing the User’s actions, violating these Rules and has the right not to disclose the specified information to third parties.
22. The Rules of the Program are governed by the legislation of the Republic of Malta. All disputes arising from these Rules shall be settled in the state court according to the whereabouts of Mirai Flights.
